NetTeller Access Agreement

To continue the Application you must agree to these terms.

The Farmers National Bank NetTeller Access Agreement ("NAA") for accessing your accounts with NetTeller, explains the terms and conditions governing the following services: account access ("NetTeller"), bill payment ("Bill Pay"), and other services offered through Farmers National Bank Online. These services and features will be collectively referred to as "Online Services". The accounts that may be accessed with NetTeller include accounts maintained with Farmers National Bank or its affiliates (“FNB”). The accounts that you are granted access to through NetTeller will be referred to as "the accounts". This NAA will be governed by and interpreted in accordance with all applicable federal laws and regulations, as previously disclosed by FNB. The following rules will apply to the extent there is no applicable federal law or regulation. The account or service you are accessing via NetTeller is maintained through Farmers National Bank and will be governed by and interpreted in accordance with the laws of the State of Kentucky. The terms "we," "us," "our," and "Bank" refer to Farmers National Bank. "You" refers to each signer on an account. The term "business day" shall mean every day except Saturdays, Sundays and federal banking holidays. FNB may, at times, introduce new online services or features. This NAA will be updated to inform you of the existence and conditions of these changes. The first time you access any of the accounts through NetTeller confirms your agreement to be bound by all the terms and conditions of this NAA and acknowledges your receipt and understanding of this disclosure.

In order to be given access to an account through Online Services you must be an authorized signer for that account. After registering for Online Services you will be assigned a user identification ("user I.D.") and password ("PIN"). The proper combination of user I.D. and PIN will be referred to as the "Access Code". The Bank will permit access to the accounts to an individual who has the Access Code. You agree not to reveal your Access Code to any individual who is not authorized to have access to the accounts. By using Online Services, you agree that it will be conclusively presumed that any access to the accounts using Online Services was done with your actual authority whether access is by you or any individual who has been furnished your access code. In the event the individual furnished your Access Code is a minor under the age of eighteen (18) years, then you do hereby consent to this NAA with said minor and agree to be bound by and legally responsible for the terms and conditions herein and for any transactions of the accounts involving said minor.

ELIGIBLE ACCOUNTS: Regular Checking Accounts, Regular Savings Accounts, Certificate of Deposit Accounts, Business Checking, Business Savings, Line of Credit, Personal Loans, Consumer Loans, Commercial Loans, Mortgage Loans.

FEES: There are no monthly, per transaction, or initial fees for accessing the accounts through the use of NetTeller. The only exceptions will be noted during transaction entry on the NetTeller website.

You agree to be responsible for any telephone charges which you incur by accessing your account through NetTeller.

BILL PAY: The Farmers National Bank Bill Pay Service allows you to schedule bill payments through NetTeller. You can arrange, at your option, for the payment of your current, future and recurring bills from an FDIC-insured checking account, up to a maximum of $9,999.00 per payee/merchant each business day. You can pay anyone in the United States except any government agency. The money will be withdrawn out of the account that you specified ("Payment Account") on the Bill Pay setup form or during Bill Pay setup on the website. This withdrawal will be made approximately two business days after the payment date you have set. The bank will treat Bill Pay items just like any other check that you write. Should the item be returned, a hold may be placed on your Bill Pay service.

Authorization: By furnishing us with the names of your payees/merchants and their addresses, you authorize us to follow the payment instructions to these payees/merchants that you provide us via NetTeller or Farmers National Bank Customer Service. When we receive a payment instruction (for the current or a future date), we will remit funds to the payee on your behalf from the funds in your selected FDIC-insured checking account. However, we shall not be obligated to make any such payment unless your account and/or overdraft protection plan has sufficient funds or credit availability to pay the bill on the Payment Date.

Fees: There will be no fees for the Bill Pay service. If you close the Payment Account, you must notify us and identify a new Payment Account for the Bill Pay service. Additionally, if you close all your accounts, you must notify Farmers National Bank Customer Service to cancel your NetTeller service.

Payments: Check payments should be scheduled 10 business days in advance of when you want the payment to actually be received by the payee. Electronic payments should be made 4 business days in advance of when you want the payment to be received by the payee. The maximum payment amount is $9,999.00 and the minimum is $0.01. You may add, edit, or delete payments scheduled Sunday through Friday until 10:00 PM Central Time of the payment date. Scheduled payments that fall over a weekend will be processed Friday evening. Any new payments that are scheduled for the current weekend, will be processed on Sunday night. Holiday processing is done the business day following the holiday. You may schedule payments up to 90 days in advance of the first due date. Recurring payments can have an end date of any year in the future. You can make multiple payments to the same payee as long as the payment amounts are different. For your protection, the system will not pay duplicate items in the same day.

Payee Information: You may have up to 99 payees that you can set up through Bill Pay. If you need more than 99 payees, please contact Customer Service. If you need to edit vendor addresses you will have to set up a new vendor with the correct address and delete the old one. Bill Pay will default to electronic payments. If a vendor does not accept electronic payments, checks will be used. Weekly, Semi-monthly, or Monthly recurring payments can be set up.

EMAIL: Sending e-mail through a NetTeller online account is the only secure way to communicate through e-mail with NetTeller customer service of the Farmers National Bank. Public e-mail is NOT considered a secure means of communication. FNB will not use public e-mail for communicating any information. Do not include any privacy information in any public e-mail communication. No liability will be assumed of FNB for damages occurring as a result of you transferring confidential information via e-mail. You cannot use e-mail to initiate transactions on your account(s). For banking transactions, please use the appropriate functions within NetTeller or call Farmers National Bank.

FUNDS TRANSFERS: The person specified in the "Personal Information" section of the NetTeller Setup Form will be permitted to electronically transfer funds between The Accounts through NetTeller by using the Access Code as features allow.

If we do not complete a transfer to or from your account on time or in the correct amount, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your account to make the transfer.
  • If the system which you are working from was not working properly and you knew about the breakdown when you started the transfer.
  • If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.

In making electronic transfers between The Accounts, the bank shall have no liability whatsoever to you for any special, general, direct, indirect, or consequential damages. Your failure to notify the bank, except for transactions to which the Electronic Funds Transfer Act Apply, within 14 days after notice is received by you for any unauthorized transaction, shall discharge the Bank from any liability to refund any unauthorized transaction.

Unauthorized Transfer Contact: If you believe your Access Code has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call or write us at the telephone number or address listed in this disclosure.

In case of errors or questions, about your electronic transfers, call or write us at the telephone number or address listed in this disclosure. We must hear from you no later than 60 days after we sent the FIRST statement on which the problem or error appeared. In your communication:

  • Tell us your name and account number.
  • Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information.
  • Tell us the dollar amount of the suspected error.

If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your account. If we decide that there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

In case of insufficient funds, your Online Service may be cancelled at any time without prior notice due to insufficient funds in one of your accounts. After cancellation, Online Services may be reinstated, once sufficient funds are available in your accounts, to cover any fees and other pending transfers or debits. In order to reinstate your services, you must call Farmers National Bank at 270-237-3141.

Fee Services: The person specified in the "Personal Information" section of the NetTeller Setup form will be permitted to place stop payments on their accounts and they will be assessed a charge of $25.00 per stop payment request. Stop payments are valid for 6 months, from the date of request. Please contact Farmers National Bank for more information.

LIABILITY: Except as specifically provided in this NAA or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, the Bank, or by Internet browser providers such as Netscape (Netscape Navigator browser) and Microsoft (Microsoft Explorer browser), or by Internet access providers or by online service providers or by an agent or subcontractor of any of the foregoing, nor shall we or the service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, NetTeller, or Internet browser or access software.

CANCELLATION: If you wish to cancel any of your Online Services offered through Farmers National Bank Online, please contact Farmers National Bank Customer Service at 270-237-3141 or send us cancellation instructions in writing to Farmers National Bank attn: NetTeller Customer Service 1595 Veterans Memorial Highway, Scottsville Kentucky 42164.

If you do not process a payment in your Bill Pay account via Farmers National Bank Online for any 90 consecutive day period, FNB will discontinue your Bill Pay service. Please note that your Bill Pay information will be retained for several months if you are discontinued, but will eventually be lost.

If you do not access your accounts via NetTeller for any consecutive 90 day period, we will deactivate your NetTeller access.
